La regulación de las pensiones de jubilación ha sido modificada de forma sustancial por la Ley 27/2011, a fin de garantizar la sostenibilidad del sistema público de pensiones, amenazado por el creciente envejecimiento de la población española.
La edad ordinaria de jubilación se situará en 67 años a partir de 2027. Desde la entrada en vigor de esta Ley se inicia un régimen transitorio que finaliza en 2027, en el que se irá incrementando gradualmente la edad de jubilación desde los 65 actuales. No obstante, en este período, quien hubiera cotizado más de 38 años y 6 meses, podrá jubilarse al cumplir 65 años con la pensión completa.
La cuantía de la pensión se calculará en base al promedio de los últimos 25 años trabajados, en lugar de los 15 actuales. Esta medida se irá aplicando gradualmente hasta el 2022, fecha en que se aplicará con carácter general.
La pensión máxima se obtendrá acreditando 38 años y 6 meses de cotización a partir de 2027, frente a los 35 años que se exigen en la actualidad.
El período mínimo de cotización exigible para causar derecho a la pensión de jubilación seguirá siendo de 15 años. La cuantía de la prestación alcanzará el 50% de la base reguladora, e irá incrementándose paulatinamente, a medida que se sumen años de cotización, hasta alcanzar el 100% de la base reguladora a los 38 años y 6 meses, antes indicados. En este sentido, los períodos dedicados al cuidado de hijos contarán como años cotizados.
Se podrá acceder a la jubilación anticipada a partir de los 63 años, siempre que se hayan cotizado al menos 33. En caso de acreditarse una situación de crisis en la empresa esta edad puede anticiparse hasta los 61 años. Esta medida también es aplicable a los trabajadores autónomos.
La base reguladora de las pensiones de viudedad se incrementará del 52% actual al 60%, para personas con 65 años o más que carezcan de otra prestación pública.
